These Terms and Conditions ("Terms") constitute a legally binding agreement between NSL Nutrition (Naama Sahar Levitt Nutrition), a private company registered in Israel (Company ID: 313558694) ("NSL Nutrition", "we", "us", or "our"), and you ("you" or "your") governing your access to and use of SmartEat, including our website (smarteat.co), the SmartEat mobile apps on iOS and Android, and related online services (together, the "Service"). By using the Service, you agree to these Terms. If you do not agree, you must not use the Service.
By using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. You represent that you are at least 17 years old and have the legal capacity to enter into this agreement. In the mobile apps, you may also be asked to accept these Terms (or an in-app version of them) electronically; that acceptance is a valid, binding agreement.
The Service is for users aged 17 and over. We do not allow use by anyone under 17.
The Service is designed to support personal health, fitness, and wellness through health tracking, personalized insights, and recommendations. The content is for informational purposes only, intended for personal, non-commercial use, and must comply with these Terms and applicable laws. The Service is not a medical device and does not provide medical advice.
The Service is part of the SmartEat family of products operated by us. In addition to the SmartEat apps and website, our product family includes Nutrition Health Academy - a companion learning app that teaches nutrition fundamentals through short, gamified lessons, quizzes, and learning paths. Nutrition Health Academy is a SmartEat product operated by us; your use of it is governed by these Terms unless separate terms are presented within that app. All educational content in Nutrition Health Academy is provided for informational purposes only and does not constitute medical advice.
You agree to provide accurate information (e.g., email, phone number) during registration and to update any changes promptly by contacting [email protected]. Depending on the platform, you may create an account with email and password and/or third-party sign-in (for example, Sign in with Apple, Google Sign-In, or Facebook Login). When you use third-party sign-in, we receive basic account information from that provider (such as name, email if available, and an app-scoped identifier); we do not receive your third-party password. You are responsible for safeguarding your credentials and device unlock methods (including Face ID / Touch ID on iOS, and PIN, pattern, password, or biometric unlock on Android) and for all activities under your account.
The Service is not a licensed medical provider. Information provided, including nutrition insights, AI recommendations, or personalized menus, is not medical advice and does not establish a physician-patient relationship. Always consult a licensed healthcare provider before making health decisions, especially if you have or suspect a medical condition (e.g., pregnancy, diabetes, heart disorders). The Service is supported by nutritionists licensed by the Ministry of Health, holding relevant degrees and specialized experience in nutrition and wellness. App features (including AI chat, scans, calculators, and written plans in the app or on the site) are educational and are not medical advice. A paid 1:1 session with a licensed dietitian is a professional dietetic service between you and that dietitian. It is not the same as Skyler or a food scan. It does not create a physician-patient relationship.
You are responsible for providing compatible devices, software, and data connections. You consent to automatic or manual updates to the Service and to receiving necessary notifications to maintain functionality.
If you choose to connect the SmartEat app to a device health platform, you grant us permission to access only the health data types you authorize:

All content and functionality of the Service are owned by NSL Nutrition (Naama Sahar Levitt Nutrition) or licensed partners and protected by copyright, trademark, and other intellectual property laws. Unauthorized use is prohibited. User-uploaded content (e.g., photos) grants us a non-exclusive, royalty-free, worldwide license to use, modify, and display such content solely for Service functionality.
Please review our Privacy Policy at https://smarteat.co/privacy-en. By using the Service, you agree to be bound by our Privacy Policy, which is incorporated into these Terms. The Privacy Policy lists our processors and where data goes. NSL Nutrition is based in Israel. Data is also processed by Google (Firebase, Analytics, Crashlytics, Google Play Billing) and OpenAI in the United States and/or the European Union. Barcode lookups may go to Open Food Facts in the EU. If you do not agree, you must stop using the Service and contact us at [email protected] to request data deletion.
The Service uses OpenAI for features such as meal scan, chat, and nutrition insights. When you use those features, photos, text, and barcodes (and related context needed for the feature) are sent to an AI model. Results are estimates only. Do not use them to identify allergens or to decide whether something is safe to eat. You must review and confirm results before logging. We do not use your content to train OpenAI models.
The Service is provided "as is" without warranties. To the fullest extent allowed by Israeli law, we are not liable for any damages (e.g., health outcomes, data loss) arising from your use. Our aggregate liability shall not exceed USD 100 or the amount you paid for the Service in the 12 months prior to the claim, whichever is greater.
You agree to indemnify, defend, and hold us, our affiliates, officers, directors, employees, and agents harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, breach of these Terms, uploaded content, violation of applicable laws, misuse of the Service, or infringement of third-party rights.
These Terms are governed by Israeli law. Disputes will be resolved in Israeli courts. Contact [email protected] for complaints. Claims must be filed within one year, as permitted by law. You agree that, except for claims requiring injunctive relief, any disputes arising from these Terms or your use of the Service will be resolved through binding arbitration conducted in Israel, in accordance with the Israel Arbitration Law, 5728-1968. You waive any right to a jury trial or to participate in a class action lawsuit. Arbitration costs will be shared equally unless otherwise required by law. You agree that any claims against us must be brought individually and not as part of a class, collective, or representative action.
We may suspend or terminate your access for violating these Terms or applicable laws, or if your use poses a risk to the Service or others.
To the fullest extent permitted by Israeli law, we provide the Service "as-is" without any warranty, express or implied, including warranties of merchantability, fitness for a particular purpose, or accuracy. We disclaim liability for errors or omissions in content, downtime, or interruptions in the Service.
We may update these Terms at any time. Continued use after changes indicates your acceptance. Review the Terms periodically on this page or in the app settings. If we make material changes, we may ask you to accept the updated Terms in the app.
The app’s UI/UX design was developed by Victoria Skokshina and is owned by NSL Nutrition (Naama Sahar Levitt Nutrition).
All trademarks, logos, and brand names are the property of their respective owners. Use of these marks does not imply endorsement.
These Terms may be provided in multiple languages for your convenience. In the event of any conflict or inconsistency between translations, the Hebrew version will prevail.
The Service uses OpenAI as described under AI Food Scan. Inputs are limited to what is needed for the feature; we do not use your content to train OpenAI models.
